Остается малоисследованной деятельность ассоциаций высших судов, в частности органов конституционного контроля. Между тем такие ассоциации многочисленны и деятельность некоторых из них актуальна для Конституционного Суда Российской Федерации. Так, КС РФ является участником двух анализируемых ассоциаций: Азиатской и Евразийской, а также наблюдателем в Африканской ассоциации. Эти объединения демонстрируют высокую активность и приверженность изначально заявленным целям, общим для подобного рода образований, прежде всего продвижению сотрудничества судов и взаимной поддержке. Ассоциации органов конституционного контроля представляют исследовательский интерес в силу их деятельности на постоянной основе, а также разнообразных и примечательных ее результатов, которые при этом зачастую являются публичными. Методология: настоящее исследование использует отмеченные доступные материалы и опирается на общенаучные и специальные методы познания: диалектический метод, метод системного анализа, системно-правовой, формально-юридический и сравнительно-правовой методы. Результаты исследования и их обсуждение: с использованием указанных методов проанализирована деятельность названных ассоциаций и сделан вывод о позитивном характере взаимодействия в их рамках. В то же время показано, что выход КС РФ из Европейской и Всемирной конференций был обусловлен явным их отступлением от уставных целей и использованием указанных площадок для продолжения внешнеполитической повестки отдельных государств, по сути, для «шельмования» (naming and shaming), характерного для неправительственных организаций, а не судебных объединений. Выводы: изученные материалы указывают на то, что «судебная дипломатия», в том числе в рамках ассоциаций органов конституционного контроля, не требует нормативного регулирования, поскольку развивается естественным образом, не затрагивает компетенцию внешнеполитических ведомств, не влечет юридически значимых последствий для государства, а фактором ограничения возможных эксцессов выступает прежде всего ответственное понимание судом своей функции.</p></abstract><trans-abstract xml:lang="en"><p>Introduction: The international activity of courts unrelated directly to administration of justice has not ceased despite ongoing conflicts and political confrontations. Activities of associations of higher courts, particularly those of constitutional review bodies, remain understudied. However, such associations are numerous, and work of some of them is relevant to the Constitutional Court of the Russian Federation. The Constitutional Court of the Russian Federation is a member of two analyzed associations: The Asian and Eurasian Associations, and an observer in the African Association. These associations are highly active, and demonstrate commitment to initially stated goals common to such entities — primarily promoting judicial cooperation and mutual support. The status and nature of the activities of associations of constitutional review bodies may be interesting to a researcher due to their continuous activities, as well as the diverse and noteworthy results, which are often public. Methodology: The present paper utilizes available materials and draws on general scientific and specialized research methods: the dialectical method, the systemic legal method, the formal legal method, and the comparative legal method. Results and Discussion: These methods were deployed for analysis of activities of these associations, concluding interactions within them are positive and useful. At the same time, it was shown that the Constitutional Court of Russia’ withdrawal from the European and World Conferences was justified by their clear deviation from their statutory goals and their use to promote foreign policy agendas of individual states, essentially for naming and shaming, a practice characteristic of non-governmental organizations rather than judicial associations.
