Методология: в работе активно используется сравнительно-правовой метод исследования, благодаря которому выделяются подходы цифровой трансформации публичной власти в США, Германии, Узбекистане, Франции, Сингапуре. Одновременно применен метод формально-юридического толкования, благодаря которому дана оценка платформизации (система «ГосТех») государственного управления в Российской Федерации. Результаты исследования: в статье выделены этапы цифровизации государственного управления. Первый этап связан с техническим наполнением (инструментальной компьютеризацией и автоматизацией) органов государственной власти оргтехникой, включая компьютеры, множительные аппараты и принтеры. Второй этап определяется наличием качественного сдвига и появлением специального понятия, отличающегося оригинальностью, — электронное правительство. Третий этап — реализация принципа GovTech, под которым понимается новая парадигма (целостная экосистема) осуществления публичной власти, основанная на сквозной интеграции цифровых платформ, больших данных и алгоритмических систем (включая искусственный интеллект) в саму суть государственного управления. Выводы: обозначены системные конституционно-правовые риски: 1) скрытая деинституционализация государства; 2) появление конкурента в области управления общественными отношениями в лице транснациональных IT-корпораций (Big Tech); 3) радикальное «вымывание» человека из пространства публично-правовых отношений, обусловливающее кризис антропоцентризма. Представлен путь минимизации – парадигма кооперации, воплощением чего становится проект «Общества 5.0», элементом которого выступает принцип «человек в контуре».</p></abstract><trans-abstract xml:lang="en"><p>Introduction: This article examines the gradual transition from the classical Weberian model of bureaucracy (based on the basic characteristics of the classical state) to algocracy in the context of the digital transformation of public administration and evaluates the concept of GovTech in the modern world. Methodology: This paper makes extensive use of a comparative legal research method, highlighting approaches to the digital transformation of public administration in the United States, Germany, Uzbekistan, France, and Singapore. A formal legal interpretation method is also applied to assess the platformization (the “GosTech” system) of public administration in the Russian Federation. Research Results: This article identifies the stages of digitalization of public administration. The first stage is associated with the technical provision (instrumental computerization and automation) of government agencies with office equipment, including computers, copying machines, and printers. The second stage is defined by a qualitative shift and the emergence of a special, distinctive concept: e-government. The third stage is the implementation of the GovTech principle, which refers to a new paradigm (an integrated ecosystem) for the exercise of public authority based on the end-to-end integration of digital platforms, big data, and algorithmic systems (including artificial intelligence) into the very essence of public administration. Conclusions: Systemic constitutional and legal risks are identified: 1) the hidden deinstitutionalization of the state; 2) the emergence of a competitor in the field of public relations management in the form of transnational IT corporations (Big Tech); 3) the radical erosion of the human element from the space of public legal relations, leading to a crisis of anthropocentrism.
