Статья прослеживает, каким образом светские правоведы, стремясь обосновать существование «желаемого X» (объективность права, автономию субъекта, прогрессивное развитие доктрины), неосознанно воспроизводят классические теологические модели мышления и доказательства бытия Бога.</p></sec><sec><title>Методы</title><p>Методы: в исследовании применяется метод сравнительного анализа юридической аргументации и теологических построений. Автор сопоставляет концепции Джозефа Била, Оуэна Фисса, Маргарет Джейн Рэддин и Джека Балкина с космологическим, телеологическим (от замысла) и онтологическим доказательствами бытия Бога, опираясь на кантовскую критику подмены эпистемического онтологическим.</p></sec><sec><title>Результаты и обсуждение</title><p>Результаты и обсуждение: в ходе анализа выявлено, что аргументация правоведов в попытке стабилизировать желаемую нормативность неизбежно содержит в себе магический переход от мысли к бытию. В первой части показано, как Джозеф Бил для обоснования саморазвития общего права использует логику «перводвигателя», сходную с доказательством Фомы Аквинского. Во второй части демонстрируется, как Оуэн Фисс, отстаивая объективность интерпретации, постулирует существование «интерпретативного сообщества» и «дисциплинирующей догмы» по модели доказательства от замысла. Третья часть раскрывает, как защита автономного «я» у современных теоретиков структурно повторяет картезианское cogito и онтологическое доказательство, не позволяя выйти за пределы языкового акта к онтологической реальности. Автор приходит к выводу, что данная подмена является не ошибкой, а конституирующим жестом права как системы, нуждающейся в иллюзии объективации для сохранения своего авторитета.</p></sec><sec><title>Выводы</title><p>Выводы: право предстает как дискурс, хронически испытывающий дефицит онтологического обоснования и потому вынужденный постоянно воспроизводить теологические структуры мышления. Продолжать «заниматься правом» после разоблачения его метафизических оснований столь же проблематично, как и продолжать религиозную службу после «смерти Бога». Сдвиг от эпистемического к онтологическому является не логическим сбоем, а необходимым условием существования самой идеи верховенства права. </p></sec></abstract><trans-abstract xml:lang="en"><sec><title>Introduction</title><p>Introduction: This paper analyzes the formal structure of argumentation in contemporary legal theory. It traces how secular legal scholars, in their efforts to substantiate the existence of a “desired X” (such as legal objectivity, the autonomy of the self, or the progressive evolution of doctrine), unwittingly replicate classical theological models of reasoning and proofs for the existence of God.</p></sec><sec><title>Methods</title><p>Methods: The study employs a comparative analysis of legal argumentation and theological constructs. The author juxtaposes the concepts of Joseph Beale, Owen Fiss, Margaret Jane Radin, and Jack Balkin against the cosmological, teleological (argument from design), and ontological proofs of God’s existence, drawing upon Kantian critique of the substitution of the ontological for the epistemic.</p></sec><sec><title>Results and Discussion</title><p>Results and Discussion: The analysis reveals that legal scholars’ attempts to stabilize desired normativity inevitably involve a magical leap from thought to being. The first part demonstrates how Joseph Beale uses the logic of the “prime mover,” akin to Aquinas’s proof, to justify the self-evolution of the common law. The second part shows how Owen Fiss, in defending the objectivity of interpretation, postulates the existence of an “interpretive community” and “disciplining rules” based on the argument from design model. The third part elucidates how the defense of the autonomous “self” by modern theorists structurally repeats the Cartesian cogito and the ontological proof, failing to transcend the linguistic act to reach ontological reality. The author concludes that this substitution is not an error but a constitutive gesture of law as a system that requires the illusion of objectification to maintain its authority.</p></sec><sec><title>Conclusions</title><p>Conclusions: Law appears as a discourse suffering from a chronic deficit of ontological grounding and is therefore compelled to continuously reproduce theological structures of thought.
