Злоупотребление доверием пользователей компьютерных сетей позволяет организованным преступным группам достигать свои экономические и политические цели, совершая правонарушения в международном информационном пространстве. Методы включенного наблюдения, сравнительно-правового и дискурсивного анализа показывают, что цифровая трансформация ослабила влияние государства на развитие культурной сферы жизни общества, а компьютерные технологии стали объектом интересов криминальных структур. Цифровая трансформация создала виртуальную реальность, которая существует на основе законов и правил сетевого сообщества. Сетевые сообщества, отвергая большинство императивных норм, навязываемых гражданскому обществу национальными правительствами в политических целях, становятся жертвами широкого круга киберпреступлений: хищений, распространения вредоносных программ и пропаганды экстремизма. Поскольку цифровая трансформация — универсальное явление, которое неизбежно изменит жизнь всего мирового сообщества, постольку необходимо достижение консенсуса по вопросу выработки и имплементации современных международных соглашений, которые, с одной стороны, гарантируют свободу слова и право каждого человека на доступ к информации, а с другой стороны, защитят граждан, государства и социальные институты от преступных посягательств в активно развивающейся цифровой среде.</p></abstract><trans-abstract xml:lang="en"><p>Cyberspace crime is a critical threat to the information security of the state and civil society institutions. Inside global network the abuse of computer user’s trust allows organized criminal groups to achieve their economic and political goals by committing offenses in the international information space. The methods of participatory observation, comparative legal and discourse analysis show that digital transformation has weakened the influence of the state on the development of the cultural sphere of society, and computer technologies have become the object of interests of criminal structures. Digital transformation has created virtual reality based on the laws and regulations of the networked community. Civil society by rejecting most of the peremptory norms imposed by national governments for political purposes produce victims of a wide range of cybercrimes: fraud and computer misuse offences and obscene publications.
