В связи с увеличением объема инвестиций растет и риск нарушения прав китайских государственных инвесторов. В данной статье автор исследует вопрос о том, есть ли право у китайских государственных компаний, контролируемых Китайской Народной Республикой, инициировать международный инвестиционный арбитраж против принимающего государства, и приходит к выводу о том, что для ответа на этот вопрос необходимо установить, реализовывала ли фактически компания государственную функцию в рамках конкретного инвестиционного проекта.</p></abstract><trans-abstract xml:lang="en"><p>Over the past decade, Chinese state-owned entities have increasingly invested abroad as part of the implementation of the People’s Republic of China Government’s Belt and Road Initiative and the “Made in China 2025” strategic plan. As the volume of investment increases, the risk of infringement of Chinese state-owned investors’ rights is also growing.
